Hahesy, as lead counsel for Nibco, Inc., secured a unanimous defense verdict in a Title VII and FEHA case after an eight-week trial in federal district court in Fresno. Nibco, Inc., an Indiana-based manufacturer, prevailed on all claims asserted by 23 plaintiffs allegedly challenging the administration of a series of employment tests. The nine-person jury unanimously concluded that the plaintiffs failed to prove that Latina and Asian employees were disparately impacted by the tests, that Nibco proved that the tests were job related and consistent with business necessity and that the plaintiffs failed to prove the existence of less discriminatory alternatives.
